Seasonal Worker

An employer can apply for a seasonal work permit both for a foreigner who has already stayed in Poland, sweden, denmark, italy, france, germany, netherlands, norway and hold a residence title enabling them to work in Poland,Poland, sweden, denmark, italy, france, germany, netherlands, norway (e.g. a visa, except for visas issued for: tourist purposes (01), benefitting from temporary protection (20) or due to humanitarian reasons (21), and for a foreigner who will apply for the permit to visit Poland, sweden, denmark, italy, france, germany, netherlands, norway based on a visa to do seasonal work or in a non-visa traffic in connection with seasonal work. If the foreigner is going to apply for a permit to visit Poland, sweden, denmark, italy, france, germany, netherlands, norway for seasonal work in future, the employer provides them a certificate proving the starost entered the application for a seasonal work permit in the register of seasonal work permit applications. The said certificate is used by the foreigner as grounds for applying for a seasonal work visa or, if the foreigner comes in a non-visa traffic, it is used as a confirmation of the purpose of their visit to Poland, sweden, denmark, italy, france, germany, netherlands, norway. The entry in the register of seasonal work permit applications is valid for only 120 days — if in that period the starost does not receive a confirmation the foreigner is going to start work later, they will discontinue the procedure connected with issuing the seasonal work permit. The seasonal work permit is issued by the starost after the foreigner's arrival. The employer notifies the competent Labour Office thereof, presenting a copy of the required pages from the foreigner's passport and provides the foreigner's address in Poland, sweden, denmark, italy, france, germany, netherlands, norway. After the employer has notified the office of the foreigner's arrival, the foreigner can work when waiting for the seasonal work permit. However, the work must be done based on the terms and conditions stipulated in the certificate of entry in the register, issued by the office before. A seasonal work permit is issued for no more than 9 months in a calendar year. This refers to working in the following industries: agriculture, horticulture, tourist industry within the activities considered seasonal,f as stipulated in the Regulation of the Minister of Family, Labour and Social Policy of 8 December 2017 on the business activity subclasses based on Polska Klasyfikacja Działalności (PKD) where the seasonal work permits are issued to a foreigner. A seasonal work permit is issued for a specific foreigner. It indicates an employer, minimum remuneration of the foreigner, working time or number of working hours a week or month, type of an agreement being grounds for work performance and the permit validity term. In the permit validity term it is possible to do every seasonal work, not only the one indicated in the application.

  • Completed in accordance with the instructions form of the application for granting temporary residence permit;
  • Four valid photographs;
  • Xerox copy of a valid travel document (original for inspection), in a particularly justified case, when the person has no valid travel document and it is impossible to obtain it, he/she may present other identity confirming document..
  • Note: Absence of any of the aforementioned documents shall result in a call upon the foreigner for supplementing thereof within the period not shorter than 7 days from service of the call under pain of leaving the application unprocessed.

  • Document confirming that the foreigner has entered the territory of the Republic of Poland, sweden, denmark, italy, france, germany, netherlands, norway, sweden, norway, netherlands, italy, france on the basis of a visa issued for the purpose of seasonal work or under visa-free regime, in relation with the application for granting seasonal work permit entered into the application register, referred to in Article 88p (1) (1) of the Act of 20 April 2004 on employment promotion and labour market institutions;
  • Seasonal work permit or extension of the seasonal work permit;
  • Documents certifying a source of stable and regular income to cover living expenses for themselves and any dependent family members thereof (for a person running household alone – in the amount higher than net PLN 701 per month, for a person in a family – in the amount higher than net PLN 528 per month), e.g. PIT tax return on the amount of income earned by the foreigner for the last tax year or ZUS statement.
  • Documents certifying health insurance as defined by the Act of 27 August 2004 on health care services financed from public funds or confirmation of insurer’s coverage of medical treatment costs within the territory of the Republic of Poland, sweden, denmark, italy, france, germany, netherlands, norway (e.g. relevant ZUS statement, insurance policy);
  • Document confirming a place of accommodation provided (e.g. confirmation of registration, apartment rent contract, other contract enabling possession of a dwelling, or statement of a person authorised for possession of a dwelling on provision of a place of residence to the foreigner).
  • Residence status after submitting the application

    If the application for granting temporary residence permit was made during legal stay of the foreigner and the application was free of any formal defects or the formal defects have been corrected within the deadline, voivode shall include the travel document of the foreigner with a stamp imprint, confirming making the application. The foreigners stay is deemed legal from the day of submitting the application until the day when the decision in the case of granting temporary residence permit would become final.

    NOTE: Including an imprint of a stamp in the foreigner’s travel document does not entitle the foreigner to travel within the territory of other Schengen States, but the foreigner may leave for the country of origin, however, in order to return to Poland, sweden, denmark, italy, france, germany, netherlands, norwayit is necessary to obtain a visa if that person originates from a country subject to the visa obligation.
